2. Scope
These Terms and Conditions of Service (TCS) apply to the use of the online member area and the digital content provided therein by Peter Frech under the name Dialect Academy (“Dialect Academy", “we,” “us,” or “our”) on the website www.dialect.academy . Through this website, various products, particularly videos, presentation slides, eBooks, and online courses (collectively referred to as “Services”), are offered to customers for a fee. Customers may be either business clients or consumers within the meaning of the Consumer Protection Act (“KSchG”) (“Customers”).
We reserve the right to change, update, or adjust these Terms and Conditions of Service at any time. It is recommended to regularly check for any changes. Changes to the TCS will become effective upon their publication on this website. If you do not agree with the changes, you are not entitled to use the Services offered on this website.
Sales of the Services are carried out through the third-party provider Digistore24 GmbH, which acts as the contractual partner. The purchase agreement is concluded between the customer and Digistore24. The Terms and Conditions of Digistore24 for Buyers (“Digistore24-TC4B”) also apply and are available on their website. According to §2 (Scope of Service), point 3 of the Digistore24-TC4B, additional product-specific terms may be agreed. These additional terms apply directly between the customer and Dialect Academy. The present Terms and Conditions of Service of Dialect Academy (“TCS”) constitute such additional terms and regulate the use of the services offered on the website. The customer accepts these TCS when concluding the contract on the external Digistore24 website (“Purchase Processing Page”). The TCS are downloadable and printable; the contract language is German.
3. Description of Services
The services provided by Dialect Academy consist of digital learning content aimed at improving the understanding of the Austrian dialect. Specifically, these are:
a) Learning Path: A series of pre-produced videos, accompanied by Google Slides with audio examples for illustration. Access is online only, with no download option.
b) Memo Cards: A series of digital cards that illustrate the individual features of the Austrian dialect, with concrete examples and audio recordings. Access is also online only, with no download option.
There are no live sessions, and all content is pre-produced.
4. Contract Conclusion and Payment Processing
The sale of the services is carried out through the third-party provider Digistore24 GmbH. The purchase agreement is concluded directly between the customer and Digistore24.
When the customer selects a product and initiates the purchase process, they are redirected to an external website (“Purchase Processing Page”), operated by Digistore24 GmbH, registered at the Hildesheim District Court under HRB 202956, St. Godehard-Straße 32, 31139 Hildesheim, Germany, www.digistore24.de. The contract for the provision of the service is concluded directly between the customer and Digistore24, not with Dialect Academy. The Terms and Conditions for Buyers of Digistore24 (“Digistore24-TC4B”) apply, which include provisions on contract conclusion, payment terms, delays, right of withdrawal, delivery, warranty, and liability limitations. A sample withdrawal form for consumers under the KSchG is also included. While Digistore24 sells the services in its own name and for its own account, the actual provision of the content is carried out directly by Dialect Academy as a fulfillment agent of Digistore24.
5. Subject of the Contract, Login Data, Access to Services
The services from Dialect Academy, purchased through the contract with Digistore24, are made available to the customer via the website (www.dialect.academy). The customer can access the services themselves.
5.1. Login Data: After completing the purchase, the customer will receive the login data (username and password; “Login Data”) directly. The customer will be automatically redirected to a thank-you page showing the login details. Additionally, the customer will receive an email with instructions and a link to activate the login data. The customer can log in to the website using these credentials and access the purchased services in the member area. The customer can also change their login data (e.g., password) independently via the website.
5.2. Confidentiality of Login Data: The customer agrees to keep their login data confidential at all times and not share it with third parties or disclose it in any way (e.g., account sharing or publication). After using the services, the customer is responsible for properly logging out of the member area. If the customer becomes aware that third parties have gained access to their login data, they must immediately inform Dialect Academy.
5.3. Use of the Services:
The customer can use the services as follows:

Videos, Audios, and Presentation Slides: These media can only be viewed online for a limited period after the contract is concluded. Downloading is not possible. The use is only permitted for the customer themselves; sharing with third parties is prohibited. The customer must ensure that they use an up-to-date web browser (e.g., Google Chrome, Mozilla Firefox, or Microsoft Edge) and that their device is capable of playing videos and audio (e.g., laptop or smartphone).

Documents: Documents can be viewed online in PDF format and downloaded to the customer's device. The use is strictly for personal purposes. The customer must ensure they have an up-to-date PDF reader (e.g., Adobe Acrobat Reader) to view the documents correctly.
The customer is responsible for ensuring a stable and functioning internet connection to access the services on the website. Dialect Academy will make efforts to keep the website continuously available. However, uninterrupted availability cannot be guaranteed, especially during necessary maintenance or due to force majeure events that may temporarily prevent access.

6. Prices and Access Period
The prices stated on the sales page are final prices and include the statutory VAT (if applicable).
Access to the learning content is granted for 12 months from the time the contract is concluded. This is a one-time payment; subscriptions or automatic renewals do not apply.
7. Usage Rights and Copyright
All provided content (videos, presentation slides, audio examples, and texts) is protected by copyright. The customer receives a non-exclusive, non-transferable, and limited-time usage right for personal use of the content. Reproduction, distribution, or public disclosure of the content is prohibited. Violations may result in legal consequences.
The customer agrees to use the content provided by Dialect Academy, including the knowledge, know-how, tools, systems, processes, concepts, and methods presented, solely in accordance with the agreed usage rights. The usage is strictly limited to personal use.
It is specifically prohibited to create and offer one's own online courses, videos, documents, books, or events (online or offline) in which the content, knowledge, or know-how of Dialect Academy is disclosed, shared, or used. It is also prohibited to offer services to third parties based on the content provided by Dialect Academy.
8. Right of Withdrawal
As the sale and payment are processed through Digistore24, the withdrawal conditions of Digistore24 apply. Customers have the right to withdraw within 60 days of the purchase date. Further information can be found in the Digistore24 TC4B.
9. Disclaimer of Liability
Dialect Academy guarantees that the services have been created with the best knowledge and care. However, a warranty or liability for the completeness and accuracy of the content, especially the knowledge and know-how presented, is explicitly excluded.
The services provided by Dialect Academy include guidelines and recommendations based on Dialect Academy’s experiences and perspectives. They serve as non-binding guidance for improving the understanding of the Austrian dialect. Practical benefit and success, however, depend largely on the individual implementation by the customer. Therefore, the content merely serves as an orientation to help customers manage the Austrian dialect in everyday life.
Dialect Academy also does not guarantee any specific learning success. The success of the content depends on the individual application and personal engagement of the user. Dialect Academy does not guarantee uninterrupted availability of the platform. Technical issues, maintenance, or force majeure may lead to temporary restrictions. Dialect Academy is not liable for damages resulting from improper use of the content.
10. Jurisdiction and Applicable Law
Austrian law applies, excluding the UN Sales Convention. The jurisdiction is agreed to be the provider’s place of business in Vienna, Austria, unless mandatory consumer protection law dictates otherwise.
Due to legal requirements, Dialect Academy informs customers that an online dispute resolution platform of the European Commission is available for resolving disputes from online service contracts at the following link: https://ec.europa.eu/odr. However, Dialect Academy does not participate in this European platform or national alternative dispute resolution procedures (e.g., the Internet Ombudsman).
11. Final Provisions
If any provisions of these TCS are invalid or unenforceable, the validity of the remaining provisions shall not be affected.
